60 MINUTE STRATEGY SESSION - TERMS & CONDITIONS

1. SERVICE DESCRIPTION

1.1 Strategy Session Service

Amplify Social Strategies ("Coach," "We," "Us") offers a one-hour Instagram strategy consultation session ("Strategy Session" or "Service") designed to provide personalized guidance and recommendations for independent musicians and performers seeking to improve their Instagram presence and create opportunities.

1.2 What is Included

Your $247 Strategy Session includes:

One (1) one-hour consultation call via Zoom
Profile audit and analysis
Personalized content strategy recommendations
Action plan for the next 30 days
Access to templates and resources discussed during the call
Follow-up email with key takeaways and resources

1.3 What is NOT Included

The Strategy Session does NOT include:

Content creation or posting
Ongoing coaching or support beyond the call
Social media management
Graphic design or video editing services
Guaranteed results or follower growth

2. PAYMENT TERMS

2.1 Payment Amount

The Strategy Session costs $247 USD (or equivalent in local currency). Payment must be received in full before your scheduled session time.

2.2 Payment Methods

Payment is accepted via Stripe or other payment processors specified at time of booking. By providing payment information, you authorize us to charge your payment method.

2.3 Payment Timing

Payment must be received within 24 hours of booking your time slot. If payment is not received within 24 hours, your booking will be automatically released and your time slot will become available for other clients.

2.4 Currency & Taxes

Prices are quoted in USD unless otherwise specified. You are responsible for any applicable sales tax, VAT, or other taxes based on your location.

2.5 Payment Disputes

All payment disputes must be reported within 30 days of the transaction date. Disputes reported after 30 days cannot be addressed.

3. REFUND POLICY

3.1 Full Refund Guarantee

If after reviewing your pre-call questionnaire, we determine that the Strategy Session is not the right fit for your current situation, you will receive a full $247 refund within 5-7 business days.

3.2 Refund Eligibility

Refunds are available ONLY if:

We determine the service is not a good fit based on your pre-call questionnaire, OR
You cancel before your scheduled call time (see Section 4 for cancellation terms)

3.3 No Refund After Session

No refunds are available after the Strategy Session has been completed. The service is non-refundable once delivered.

3.4 Refund Process

Refunds will be issued to the original payment method within 5-7 business days. You will receive a confirmation email when the refund is processed.

4. CANCELLATION & RESCHEDULING POLICY

4.1 Rescheduling

You are entitled to ONE free reschedule if you need to change your scheduled time. To reschedule, contact us at least 24 hours before your session time.

4.2 Cancellation Before Call

If you cancel more than 24 hours before your scheduled session, you will receive a full refund.

If you cancel less than 24 hours before your session, the $247 payment is forfeited and no refund will be issued.

4.3 No-Show Policy

If you do not show up to your scheduled call and do not cancel within 24 hours before the scheduled time, the $247 payment is forfeited and no refund will be issued.

4.4 Coach Cancellation

If Coach needs to cancel or reschedule your session due to unforeseen circumstances, you will be notified as soon as possible and offered an alternative time or a full refund.

5. RESCHEDULING LIMITS

5.1 Reschedule Limit

You are allowed ONE free reschedule per booking. After that, additional reschedules require a new payment of $247 for the new session time.

5.2 Missed Reschedule

If you miss your rescheduled session and do not cancel at least 24 hours before, no additional rescheduling will be offered and your original payment will be forfeited.

6. INTELLECTUAL PROPERTY & MATERIALS

6.1 Coach Materials

All templates, guides, frameworks, and materials provided during the Strategy Session remain the intellectual property of Amplify Social Strategies. You may use these materials for personal, non-commercial use only.

6.2 Your Content

You retain all rights to your music and Instagram content. By sharing your music or profile with Coach during the session, you grant Coach the right to review and provide feedback.

6.3 Use of Your Information

Coach may use anonymized testimonials, case studies, or results (without identifying information) for marketing purposes unless you explicitly request otherwise.

7. CONFIDENTIALITY & PRIVACY

7.1 Confidentiality

Coach agrees to maintain confidentiality regarding any personal or business information you share during the Strategy Session, except as required by law.

7.2 Exceptions to Confidentiality

Confidentiality does not apply to:

Information that is already publicly available
Information you authorize Coach to share
Information required by law or court order

7.3 Recording & Consent

By attending the Strategy Session, you consent to Coach recording the call for quality assurance, training, and internal review purposes. Recordings will not be shared with third parties without your consent.

7.4 Data Privacy

Your personal information (name, email, Instagram handle) will be used solely for coaching purposes and to send follow-up materials. Coach complies with applicable privacy laws and will not sell or share your information with third parties.

8. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

8.1 No Guarantees

Coach makes no guarantees regarding specific results, including but not limited to:

Follower growth
Engagement rates
Opportunities or bookings
Income or revenue generation
Algorithm changes or platform updates

Results depend entirely on your implementation, consistency, and external factors beyond Coach's control.

8.2 "As-Is" Service

The Strategy Session is provided "as-is" without warranties of any kind, express or implied.

8.3 Limitation of Liability

In no event shall Coach be liable for:

Indirect, incidental, or consequential damages
Loss of income, opportunity, or business
Emotional distress or mental health impacts
Any damages exceeding the amount paid for the Strategy Session

8.4 Your Responsibility

You are responsible for:

Implementing recommendations at your own discretion
Verifying all information independently
Consulting with professionals (lawyers, accountants, therapists) for matters outside coaching
Complying with Instagram's terms of service and all applicable laws

9. ASSUMPTION OF RISK

9.1 Personal Responsibility

You acknowledge that you are solely responsible for your actions, decisions, and results based on information provided during the Strategy Session. Coach is not responsible for any consequences resulting from your implementation or non-implementation of recommendations.

9.2 Mental Health & Emotional Wellbeing

Coaching is not a substitute for mental health counseling, therapy, or medical advice. If you are struggling with mental health issues, please seek support from a qualified mental health professional.

10. CANCELLATION OF SERVICE

10.1 Right to Decline Service

Coach reserves the right to decline to provide the Strategy Session to any individual for any reason, including but not limited to:

Disrespectful or abusive communication
Misalignment of values or goals
Inability to help based on current situation

In such cases, a full refund will be issued.

11. INSTAGRAM POLICY COMPLIANCE

11.1 Instagram Compliance

All recommendations provided during the Strategy Session are designed to comply with Instagram's Community Guidelines and Terms of Service. You agree to follow Instagram's terms and will not use any recommendations to engage in prohibited activities including:

Buying followers or engagement
Spamming or harassment
Hate speech or discrimination
Copyright or intellectual property violations
Any other violation of Instagram's terms

12. MODIFICATIONS TO TERMS

12.1 Right to Modify

Coach reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting. Your continued use of the Strategy Session service constitutes acceptance of modified terms.

13. ENTIRE AGREEMENT

13.1 Complete Agreement

These Terms and Conditions, along with any contract for the 90-day coaching program, constitute the entire agreement between you and Coach regarding the Strategy Session service.

14. GOVERNING LAW

14.1 Jurisdiction

These Terms and Conditions are governed by the laws of Virginia, USA, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any disputes arising from these Terms and Conditions shall be resolved through:

Good faith negotiation between parties
Mediation (if negotiation fails)
Binding arbitration or litigation in Virginia courts as a last resort

15. SEVERABILITY

15.1 Severability Clause

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. ACKNOWLEDGMENT

By purchasing and attending the Strategy Session, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You also acknowledge that:

You are at least 18 years old
You have the authority to enter into this agreement
You understand that no refunds are available after the session is completed
You understand that results are not guaranteed
